State Police at Coudersport arrested an Austin teenager in a series of burglary and theft incidents recently, followed by an arrest of the same teen for Unauthorized Use Of An Automobile on charges filed by Austin Police. 

Benjamin Thomas Simms, 19, of Austin, PA, was arrested by Trooper Justin Lemaire and arraigned before District Judge Annette L. Easton on March 22 at 6:00 PM on the following charges:


Simms was released on $25,000. unsecured bail and was to reappear for a preliminary hearing on April 4th at 2:00 PM.

Then on Tuesday, March 26th, Austin Police Chief Kyle Day was called to the residence of John R. And Annette Simms in Austin, and took a report of a n unauthorized use of a vehicle. Their blue Dodge Dakota truck had disappeared and that Benjamin Simms had taken the truck without his father's consent.

An arrest warrant was issued for misdemeanor Unauthorized Use of an Automobile and a BOLO issued to all area police agencies. Benjamin Simms was arrested on March 26th and arraigned before Judge Easton at 5:15 PM and committed to the Potter County jail in lieu of  $5,000. straight cash bail. He now faces a preliminary hearing on this charge and a Bail Revocation Hearing for the previous charges on April 4th at 2:00 PM.

On information filed with the District Court, Trooper Justin Lemaire detailed incidents of Burglary and Theft that Simms was first arrested on on March 22nd:

On 03/19/13. Tpr. BUTLER of PSP Coudersport investigated a burglary of a shed, which was located on Crandall Rd. within Sylvania Township, Potter County, PA. The owner of the shed was Robert MASON. The actor(s) forced entry to the shed by prying the hasp and damaging a padlock and the wood structure underneath, causing approximately $100. in damage. Nothing was stolen on entry into the shed. 

On 03/21/13, Tpr. BUTLER took a complaint from Paul PEKALA. stating that actors stole approximately 5 gallons of gas from 3 different gas cans located on his property. The approximate value of the gas stolen is $20.00. This theft occurred on his property located on East Fork Rd., approximately 3 rniles west of Cherry Springs Park, within Wharton Township, Potter County, PA.

On 03/20/13, Tpr. LEMAIRE of PSP Coudersport investigated a burglary of a shed, which was located off of Southwoods Rd. on Dry Run, Sylvania Twp., Potter County, Pa. The owner of the shed was Christine MURPHY. The actors forced entry Into the shed by cutting and prying the hinges and padlocks off with a hatchet, causing damage to the locks and the wood shed. Approximately $100 in damage. Nothing was stolen on entry into the shed. 

On 03/20/13, Tpr. LEMAIRE of PSP Coudersport investigated a burglary of a shed, which was located at 2256 First Fork Rd., Sylvania Twp .. Potter County, Pa. The owner of the shed was Reilly PERRETT. The actors forced entry to the shed by prying and cutting the hinges and padlocks off, causlng damage to the locks and wood shed. Approximately $100. in damage. The approximate value of gas stolen was $40.00.

On 03/20/13, Tpr. LEMAIRE of PSP Coudersport investigated a burglary of a shed, which was located at 2283 First Fork Rd .. Sylvania Twp .. Potter County, Pa. The owner of the shed was Eugene POUNDS. The actors forced entry to a trailer by prying and cutting the hinges and padlocks off, causing damage to the locks and wood shed. Approximately $750. in damage. Nothing was stolen.

On 03/20/13, Tpr. LEMAIRE of PSP Coudersport investigated a burglary of a shed, which was located at 1070 Southwoods Rd., Sylvania Twp., Potter County, Pa. The owner of the shed was Eugene BLYSTONE. The actors forced entry to the shed by prying and cutting the hinges and padlocks off. causing damage to the locks and wood shed. Approximately $100. in damage. Nothing was stolen on entry into the shed.

On 03/20/13, Tpr. LEMAIRE of PSP Coudersport investigated a burglary of a shed, which was located at 1815 Southwoods Rd., Homer Twp., Potter County, Pa. The owner of the shed was Richard BUSH. The actors forced entry to the shed by prying and cutting the hinges and padlocks off, causing damage to the locks and wood Shed. Approximately $100. in damage. Nothing was stolen on entry into the shed.

On 03/22/13, Tpr. LEMAIRE received a phone call from Cpl. Mark SIPLE of Emporium Boro PD. He related to me that he had conducted a traffic stop on Benjamin SIMMS for a traffic violation on 03/21/13. During the course of this stop, SIPLE saw in plain view drug paraphernalia. SIPLE placed SIMMS under arrest and conducted a consent search of the vehicle. SIMMS vehicle was impounded and a consent to search found more paraphernalia. SIPLE contacted us because he wanted to know if anyone knew SIMMS. SIPLE also asked me If we have had any recent gas thefts. SIPLE also related that there were cut locks and broken handles to hatchets or sIedges. SIPLE also related that there was siphoning equipment and gas cans in the bed of the truck.

On 03/22/13. Tpr. LEMAIRE went to 211 Summit St., Austin, Pa. 16720, to speak to Benjamin SIMMS. SIMMS related to me that he had some Involvement with the gas thefts. SIMMS then came to PSP-Coudersport and gave a written statement to the crimes that had occurred confessing to the listed crimes.
